Before this reform came into force, it was the company or legal entity that was responsible for the crime, but since July 1, 2015, the administrator or manager of the company is also punished for having allowed these practices.


– Fines of up to 280,000 euros.

– Suspension of the offending company’s activities for up to 5 years.

– Disqualification from obtaining public subsidies and aid, from contracting with the public sector and from enjoying tax or Social Security benefits and incentives (for a maximum period of 15 years).

In addition, this reform imposes a series of obligations on companies to comply with: they must have legal software if they want to continue developing their activity, implement a series of control measures to apply in the event of fraud and sanction those responsible in the event of non-compliance with the control measures.
